Distance Sales Agreement


This agreement regulates the rights and obligations of the parties regarding the sale and delivery of products ordered by the Buyer from the Seller's www.sivrilermobilya.com website, mobile application, or other electronic channels, within the framework of Law No. 6502 on the Protection of Consumers and relevant legislation provisions.

3. DEFINITIONS

Standard Product: Products that are mass-produced, not altered in their specifications according to the Buyer's request, in their original packaging, and not assembled (even if assembly is required).

Customized (Special Order) Product: Products that are produced by altering specifications such as size, color, fabric, material at the Buyer's request, designed personally, or unsuitable for return due to health-hygiene reasons (bed, pillow, duvet, etc.). Products that have been assembled or whose original packaging/tags have been opened are also considered within this scope.

Delivery with Transportation: Delivery of the product to the address by the Seller's own or contracted transportation teams.

Delivery by Cargo: Delivery of the product to the address or branch by contracted cargo companies.

Right of Withdrawal: The consumer's right to withdraw from the contract without any penal liability and without giving any reason within 14 days from the delivery date for standard products, in accordance with Law No. 6502.

4. ORDER, PAYMENT AND PRICE

4.1. The quantity, unit price, total amount including VAT, and selected payment method of the product(s) subject to the order are confirmed on the order confirmation screen and on the invoice.
4.2. Prices are the valid prices at the time the order is placed. The Seller reserves the right to change campaigns and prices. Price difference refunds are not made during discount periods.
4.3. Payment Methods:
- Payment by Credit Card: Installment options are subject to bank and Seller campaigns. Interest may be reflected by the Seller. The Buyer is responsible for the accuracy and secure use of card information.
- Payment by Transfer/EFT: Payment must be made to the accounts notified after order confirmation within 2 business days (with the order number written in the description). Otherwise, the order is canceled.
4.4. If payment cannot be received or the bank does not approve, the order is considered invalid.

5. DELIVERY, TRANSPORTATION AND ASSEMBLY

5.1. Products are delivered to the delivery address specified by the Buyer (or to an authorized person at the address) within the average delivery times stated on the website, after order confirmation and payment verification.
5.2. Delivery Types and Conditions:
- Delivery with Transportation: An appointment is made by contacting the Buyer before delivery. If the appointment is not adhered to or the Buyer is not present at the address, an additional transportation fee may be requested for the second delivery. In buildings higher than the 4th floor and without an elevator, any additional costs and risks arising from carrying the product via stairs belong to the Buyer.
- Delivery by Cargo: Delivery is made by the cargo company. The product should be checked along with its packaging at the time of delivery, and if there is damage/deficiency, a report should be obtained from the cargo officer. Otherwise, the Seller does not accept responsibility.
5.3. Assembly Service: Separately purchased assembly service is scheduled within at most 7 business days after product delivery. Electrical, water, gas installations are not performed by the Seller. If an assembled product is returned, disassembly is the responsibility of the Buyer.
5.4. Future Date Delivery: Can be postponed up to 2 months at the Buyer's request. Products not received after this period are returned and their fee is refunded. A storage fee (monthly 2000 TL) may apply.
5.5. Delivery is not made to islands and some districts. Long-distance delivery fees are announced on the website.

6. RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE

6.1. Right of Withdrawal (Standard Products): The Buyer can return standard products within 14 days from the date of receipt, without giving any reason and without paying any penalty. For the right of withdrawal to be exercised, the product must be unused, its packaging and tags intact, and complete with accessories.
6.2. Products Outside the Scope of Right of Withdrawal (Customized Products): The right of withdrawal does not apply to the following products:
- All furniture specially produced by altering size, color, material, fabric at the Buyer's request.
- Products that cannot be returned due to personalization and health-hygiene rules (bed, pillow, duvet, etc.).
- Products whose original packaging, tags, or protective tapes have been opened during delivery.
- Products assembled by the Seller or the Buyer.
- Display, outlet, or discounted products.
6.3. Return of Customized Products (Seller's Initiative): For customized products without the right of withdrawal, the Seller may, entirely at its own initiative and without obligation, accept return requests within 14 days after delivery, by deducting 30% of the product price + transportation/assembly expenses.
6.4. Return and Exchange Procedure:
- Return requests must be notified to info@sivrilermobilya.com or the call center at 0539 542 11 33 within 14 days from the delivery date.
- Returns of products delivered with transportation must be made by the Seller's team, while returns of products delivered by cargo must be made by the Buyer (in original packaging and packaged against cargo damage).
- Return cargo fee for products delivered by cargo belongs to the Buyer.
- In flawless (arbitrary) returns, the initial delivery and long-distance fees paid by the Buyer are deducted from the refund amount.
6.5. Order Cancellation and Fabric Change: Orders for which production has not started can be canceled free of charge within 3 days from the order date. Fabric selection can be changed on the day the order is placed or the next day.

7. WARRANTY AND AFTER-SALES SERVICES

7.1. Products sold by the Seller (excluding Living products) are covered by a 2-year warranty. The warranty is valid for the delivery address declared by the Buyer in the order.
7.2. The warranty covers defects arising from production or material. Malfunctions due to user error, accident, incorrect assembly, relocation, natural disaster, or normal wear and tear are not covered by the warranty.
7.3. Malfunction notification must be made within 14 days after delivery. The Seller commits to resolve the issue within 30 days following the notification. Repair costs under warranty belong to the Seller.
7.4. For products that cannot be repaired or for which spare parts are not available, the Seller reserves the right to replace with a similar product or refund the fee.

8. PAYMENT REFUND

8.1. The payment refund process is initiated within 7 business days following return approval and the product reaching the Seller.
8.2. Refund to Credit Card: The refund is credited back to the same credit card and according to the bank's procedure (usually in installments) as the payment was made from and in how many installments.
8.3. Refund by Transfer/EFT: The refund is made to the account from which the payment was made (as declared by the Buyer).
8.4. In promotional purchases, if the remaining amount after the refund does not meet the campaign conditions, the campaign is considered invalid, and the refund is calculated based on the non-promotional price.

9. PERSONAL DATA AND VISUALS

9.1. The Buyer permits the Seller to process their personal data to carry out order and delivery processes, provide after-sales service, and within the scope of legitimate commercial activities (marketing, statistics, etc.).
9.2. The Buyer agrees that product visuals taken after delivery/assembly may be used by the Seller for promotion, advertising, and social media content. This permission can be revoked by the Buyer's written request, but no rights can be claimed over content published before revocation.

10. SPECIAL PROVISIONS (SPECIAL ORDER AND FURNITURE SERVICES)

10.1. Special Order Products and Changes: Color, size, material change, or order cancellation requests made by the Buyer after special order production has started can only be accepted on the condition of paying an additional fee of 40% of the product price. The Seller has the right to reject requests that are not reasonably feasible for production.
10.2. Furniture Services (Repair, Assembly, Fabric Change, etc.): There is no right of withdrawal for additional services requested for products purchased from elsewhere or whose warranty has expired. In cancellation requests after the service has started (on-site inspection/product pickup), the incurred expenses are collected from the Buyer.

11. FORCE MAJEURE

In cases beyond the Seller's control such as war, terrorism, natural disaster, fire, strike, power outage, general health issue, etc., delivery and service times may be postponed or the contract may be considered invalid.

12. DISPUTE RESOLUTION AND JURISDICTION

In disputes arising from this contract, it is mandatory to first apply to the Izmir Consumer Disputes Arbitration Board. In the absence of an authorized board, the Izmir Consumer Courts have jurisdiction.

13. EVIDENCE AGREEMENT AND EFFECTIVENESS

13.1. The parties agree that all records and documents kept in electronic media (e-mail, SMS, website records, voice recordings, etc.) will constitute conclusive evidence in any dispute.
13.2. This agreement is considered electronically signed and becomes effective upon the Buyer's confirmation of the order and payment. The order confirmation, pre-information form, and invoice are integral parts of the agreement.

THE BUYER declares that they have read, understood, and accept all provisions of this agreement, especially products outside the scope of the right of withdrawal, payment and delivery conditions, and the processing of personal data.
