SIVRILER FURNITURE MEMBERSHIP AGREEMENT AND TERMS OF USE

1. SUBJECT AND SCOPE

1.1. This Membership Agreement and Terms of Use ("Agreement") regulates the rights and obligations between Sivriler Furniture ("Company") and real and legal person users ("Member") who create a membership registration and benefit from the services of the internet site ("Site") operated by the Company at the domain www.sivrilermobilya.com and related mobile applications ("Platform").
1.2. Every person who accesses and uses the Platform in any way is deemed to have read, understood, fully accepted, and pre-accepted the binding nature of the provisions of this Agreement.

2. MEMBERSHIP PROCEDURES

2.1. Registration and Accuracy Commitment: To shop from the Platform or benefit from certain services, a membership registration must be created. All information requested during membership registration (name-surname, email address, phone number, address, etc.) must be filled out completely, accurately, and up-to-date. The Member is obliged to update any changes to this information immediately via the Platform.
2.2. Password and Account Security: The Member is responsible for the confidentiality and secure use of the password created specifically for the Member. The Company cannot be held responsible for any adverse consequences and legal liabilities arising from the use, loss, or theft of the password by others. The Member must immediately inform the Company in case of a suspicious situation.
2.3. Account Confirmation: The membership application may be rejected or later suspended/terminated by the Company without stating any reason. Membership is for personal use only; it cannot be used for commercial purposes or transferred to third parties.

3. MEMBER'S OBLIGATIONS AND UNACCEPTABLE USES

The Member cannot use the Platform for the following purposes or encourage these actions:
3.1. Engaging in activities contrary to laws, general morality, and public order.
3.2. Infringing the intellectual and industrial property rights of the Company or third parties.
3.3. Sharing misleading, threatening, insulting and profane, pornographic, racist, sexist, religion or belief-based discriminatory content.
3.4. Sending viruses, Trojans, malicious software, or engaging in activities that endanger system security (hacking, spam, phishing, etc.).
3.5. Attempting to obstruct or disrupt the technical operation of the Platform.
3.6. Collecting or sharing other users' personal information without permission.
3.7. Establishing unauthorized communication for commercial advertising, promotion, pyramid marketing, etc.
3.8. Abusing social sharing tools such as "Invite a Friend" to send spam or attempt to gain unfair profit.

4. COMPANY'S RIGHTS AND OBLIGATIONS

4.1. Service and Content Change: The Company reserves the right to change, update, or discontinue the services, products, content, design, all kinds of information offered on the Platform, and this Agreement without prior notice. Changes become effective upon publication on the Platform.
4.2. Links: The Platform may contain links to third-party sites not under the Company's control. The Company is not responsible for the content, privacy policies, or services of these sites.
4.3. Limited Liability: The Company is not liable for direct or indirect damages arising from technical failure, interruption, data loss, delay, or errors (software/hardware related), or for inability to provide services due to force majeure (war, terrorism, natural disaster, strike, power outage, etc.).
4.4. Termination of Membership: The Company has the right to unilaterally suspend or terminate the membership without prior warning if the Member violates the provisions of this Agreement, engages in fraudulent or unfair actions, acts in a manner damaging the Company's commercial reputation, or if the information provided is found to be incorrect/incomplete. In this case, all points, coupons, and other promotional rights earned by the Member are lost.

5. INTELLECTUAL PROPERTY RIGHTS

5.1. All content on the Platform (software, design, logo, trademark, icon, graphic, photo, text, etc.) is the property of the Company or licensed third parties and is protected under Law No. 5846 on Intellectual and Artistic Works and Law No. 6769 on Industrial Property.
5.2. Without the prior written permission of the Company, the Member cannot copy, reproduce, modify, distribute, publish, use for commercial purposes, or integrate the said content into another website. Contrary actions give rise to legal and criminal liability.

6. CAMPAIGN, COUPON, AND PROMOTION RULES

6.1. Campaigns and coupons are valid within the date, duration, and conditions determined by the Company. The Company may change or terminate campaign conditions and end dates without prior notice.
6.2. Generally, only one campaign code or one coupon code can be used per order. Different campaigns and coupons cannot be combined.
6.3. The participation of members found to have participated in campaigns through fraudulent means (using bots, creating fake accounts, exploiting system vulnerabilities, etc.) is deemed invalid, their rewards are canceled even if won, and their membership is terminated. This rule also covers campaigns organized via social media.

7. PROTECTION OF PERSONAL DATA

7.1. Personal data belonging to the Member will be processed in accordance with Law No. 6698 on the Protection of Personal Data ("KVKK") and relevant legislation.
7.2. Clarification and Explicit Consent: During and after membership registration, detailed information about the purposes for which your personal data will be processed, to whom it may be transferred, and your rights are explained in the "Clarification Text on the Processing of Personal Data". By becoming a member and using the Platform, you are deemed to have read this Clarification Text and given explicit consent for the processing of your personal data for the stated purposes.
7.3. Communication and Marketing: By becoming a member of the Platform, the Member also accepts that the Company may send commercial electronic communications (email, SMS, phone) to them, including service notifications regarding membership, order, account security, as well as product/service introductions, campaign and promotion announcements. The Member can opt out of this communication at any time by written notification via the membership panel or communication channels.

8. COMMUNICATION AND NOTIFICATIONS

8.1. You must convey all kinds of requests, opinions, suggestions, and complaints regarding the Platform to the Company through the following channels:

8.2. All notifications to be made by the Company to the Member will be deemed valid upon sending to the Member's registered email address or announcement on the Platform.

9. DISPUTE RESOLUTION AND JURISDICTION

9.1. The laws of the Republic of Turkey shall apply in the resolution of any disputes arising from or related to this Agreement.
9.2. In the resolution of disputes, Izmir Consumer Dispute Arbitration Boards and Consumer Courts are primarily authorized.

10. EFFECTIVENESS AND AMENDMENT

10.1. This Agreement becomes effective between the parties upon completion of the membership process on the Platform.
10.2. The Company reserves the right to unilaterally amend the Agreement if deemed necessary. The current Agreement text is always published on the Platform. The Member's continued use of the Platform after the amendments means acceptance of the amendments.

IMPORTANT WARNING: This Membership Agreement is separate from the "Distance Sales Contract" and "Pre-Information Form" regarding your purchases made through the Platform. Please read the relevant contracts carefully for your specific rights and obligations regarding your purchase transaction.
